Should Israel be investigated for war crimes?

In December 2019 the International Criminal Court (ICC) announced it would be opening an investigation into possible war crimes committed by Israel during the Israeli-Palestinian conflict. This decision was met with a fierce backlash from Israeli politicians, with Prime Minister Benjamin Netanyahu calling it “pure anti-Semitism” and others arguing against the legality of the case. The ICC’s chief prosecutor Fatou Bensouda however says she is confident “war crimes have been or are being committed”. Is the ICC right to investigate Israel for war crimes against Palestinians or is this in fact unfounded or ansi-Semitic? timesofisrael.com/international-criminal-court-probe-of-israel-is-pure-anti-semitism-says-pm theguardian.com/law/2019/dec/20/icc-to-investigate-alleged-israeli-and-palestinian-war-crimes

Yes – and prosecute those accountable for war crimes

Fatou Bensouda of the International Criminal Court remains so confident about the investigation as clearly war crimes have been committed, and Israel’s failure to hold anyone accountable for these war crimes is exactly why the ICC was formed, to prosecute when national courts are unwilling or unable to. The official Israel response to this was disgusting and groundless, and a complete misuse of the term 'anti-Semitic', and this is clearly false considering the investigation is targeting both the Israel military, political and judicial establishment as well as Hamas and Palestinian armed groups, not just the people of Israel in general as claimed. Politicians in Israel have also questioned the sovereignty of Palestine and pointed out that as a non-sovereign region Palestine cannot sign the Rome Statute that gives the ICC jurisdiction. However the ICC’s jurisdiction covers signatories of the Rome Statue or states that have officially accepted the jurisdiction of the ICC, something that Palestine did on the 1st of January 2015.
